The reality is that there needs to be severe punishment for knowingly accusing someone of a crime they did not commit. That should definitely not mean that if the accused is found not guilty, then the accuser is charged with a crime. Absolutely not. The punishment needs to be enough to deter people from making these false accusations. Honestly, I think community service and being placed on the sex offenders list should do it.

So yea, throw a DUI suspect in jail for the night. If the police witness a domestic violence situation, or there is strong evidence that domestic violence occurred, put him in jail. If there is a chance the accused will retaliate on the accuser, sure…lock him up.

However, is there really a risk for someone who has no previous record, and is accused of a non-violent rape while the only evidence is the woman’s word? Where is the risk? And if the risk is real, how come people get out on bail?

Perhaps I don’t understand what the actual purpose of an arrest is.

Definitely should be named and get jail time equivalent to what the charge the falsely accused would have go. T if wrongly found guilty.
