My father got a fraudulent divorce from my mother by claiming that she had moved to Arizona and that was the last he had heard of her, (we live in Ohio about 30 miles from where he lived). He was granted the divorce unbeknownst to my mother or us and re-married. When he died is when we found out. My mother got the fraudulent divorce vacated which in turn invalidated the second marriage thereby making my mother the wife of record for his life insurance. So the truth won out in the end.

WTF? W Think about what this means. Say if one of you got divorced. She could just come up with some technicality, say it was forced, Your dead, their lawyer takes control of your assets you were going to give to say, other kids you had… and they would be able to go against your will. Even if you hired a PRIVATE COMPANY to handle your life insurance, they will bed over backwards to HER.. The person that never gave them a dime..

Also he is only subject to criminal prosecution if his wife can find a prosecutor that would take this case. I do not know about Texas but in most states the prosecutors are way to busy to take on a victimless crime.

Not as bad as a Metropolitan worker having his girl friend come in with his wifes Id and sign away her survival rights under his pension so that he upon retirement the next month got a slightly higher pension. A couple of months later he divorced his wife. When he died about 6 years later his ex-wife did not receive the life ins lump sum payout because she was no longer (per the scam) entitled to it. Well there is a right/legal way to divorce someone. Shoulda just tore the bandaid right off. i dont agree with the ten years, Imwould say he should get the same softball treatment they’d give a woman who did the same thing. Any good lawyer will look up case law and see what women have received for doing the same thing.
