I think the ‘deception’ has to be a bit more then that. If you google (and I admittedly didn’t spend much time), it seems the cases have been where someone actually pretended to be a different gender, or specifically someone else. The example I saw is if BF leaves the bed, and another man sneaks in to have sex with his GF, her assuming it’s BF.

I can see why a woman would be upset about a lie about income, but that isn’t a misrepresentation per se of the facts surrounding the sex act itself, since there is no promise of his income being a benefit to her. If there was, that would be prostitution.

Although I am no fan of this behavior, I would not want to make it a legal matter. The implications go way too far, and honestly, I think it would impact women just as negatively as men. Almost certainly, it would be waste of money with ‘he said, she said’ nonsense.
