I am meeting with my attorney soon for pre-trial preparation. Some background; this is a no fault divorce, short marriage, one child, I put her through school, my education completed before marriage and I assume all debt obligation.

To the men who went through this process and those with suggestions, what kinds of questions and preparation did your lawyer have for you? What suggestions do you have of questions to ask my lawyer regarding trial prep?

I have a list of topics and questions written down, but want to hear your suggestions. I’ve made extensive plans, but we all know that no battle plan survives first contact.

    Thanks

A co-worker recently told me, "If you want to see who someone really is, divorce them." I have found out how true this is. When your wife drops the façade of being the caring partner, you will witness all of the greed, hate, and spite that she has masked. It is truly breathtaking!

    Thanks JVB!

I think I have all my ducks in a row, but I like to be prepared for the unexpected.

Make sure that you can trust your lawyer to act in your best interest, not his own.

A lot of them will talk big, like they’re going to really sock it to the ex and/or her lawyer, but when it comes to the meetings or the trial, he hands it all over without even a whimper.

Even if there is a nothing to fight over, the child support/alimony/mortgage etc., can really financially and emotionally destroy a man for the rest of his miserable life and the lawyer will have forgotten about you as soon as he’s collected his final payment.

Get it set in your attorney’s mind and yours, that when she lies in court, you will EEmediately speak into your attorney’s ear.
I fell for the “write a note and show it to me bulls~~~” –
    OK for perturbabuls,
but when she lies or obviously intentionally tries to deceive,
“in your lawyer’s ear” would have done wonders.
Scour your initial wedding license. My lawyer missed where she had 3 years of college Completed.
Get sleep / get active rest from this / but,
“It was a lesson I never forgot, total preparation is the key to success and victory.”
Also, for female lurkers hoping to learn here,
    a bit of advice,
Go f~~~ yourselves, and when you’re done, f~~~ yourselves again.
Those f~~~ing ‘gal-pals’ dump the bitch faster than anyone. They only want to destroy what anyone has.

"It seems like there's times a body gets struck down so low, there ain't a power on earth that can ever bring him up again. Seems like something inside dies so he don't even want to get up again. But he does."

    You’re in the U.S, right?

    Pre-trial preparation:
    Some lubricant.
So the ass-reaming will go smoother.
    A big stick.
To beat your lawyer over the head with afterwards.

I seriously hope it goes better than that for you but as Bestoff said, the child support/alimony/mortgage… will f~~~ you up.

You’d be better off saving your money, taking your child and getting the f~~~ out of dodge in a non-extradition country.

Good luck and keep us posted.

Don't let them Blame, Shame or Tame you!

Pay attention in court, no emotions, no joking, straight face, and be astute!

It’s your ass, play the part!

Be ready for your child to be used as a pawn. They will talk about your child like all the other possessions.
Make sure you have a good lawyer you trust. Document EVERYTHING. Get as much custody as you can. Put in the divorce decree neither of you can have a love interest at your residence while child is there unless preapproved by other party.
Understand you will lose more ground than you gain right now, but it’s all about the long game.
After the divorce is just as important. I’ve won more ground after the divorce because she’s made tons of mistakes that are documented than I have. She is terrified that I’ll take her to court this time around because I have more ammunition. It’s the start of the cold war for you now. You build up your arsenal bigger than hers and hope you don’t have to use it, but be willing to if need be.
    Good luck, brother.

Good luck. The US “Family” Court system is a travesty of justice and you will want to puke as you watch the courts placate your ex. But remember each day you get closer to financial freedom from her. I have walked in your shoes and there is light at the end of this tunnel.

… this is a no fault divorce …

It won’t be, by the time her lawyer has finished with it.

Expect to be accused of DV, child abuse, the whole works. Be ready to defend yourself at a moments notice.

And to then put the boot in.

    Hard.

your answers should be yes, no, i dont know. i dont understand the question is also good. do not answer with more information. do not explain anything. legal world is not rational.

women will lie, and will end up with your cash and prizes. whatever you thought was yours is not yours.

i wanted short quick and cheap divorce. i ended up on a 6 year road to hell costing over $300,000.

write down as much as you can about your married life. include weather report, news from the day. research this on the internet. add your persomal feelings about these things. July 19, 2015, sunny day, i wish i could go golfing today, quarterback bret farve had his number retired that day, to the joy of Chicago bears fans everywhere, the guy was the devil. presenting a journal of some type is better than nothing. keep a journal and receipts from now on. then when you report on her bulls~~~, you have evidence. or she makes up s~~~ about you, you have an alibi.

in court, keep your mouth shut, do not look at the c~~~. read the law. you are your own best friend, not your lawyer. lawyer cannot lie for you. be calm. assume everything will betaken away from you, be surprised if you keep any of it. sign away individual possessions, let her choke on it. your future things will be better. stick her with as much financial expense as possible.

you want quick and easy, she wants drama and attention. good luck with that. recreational litigation is what my attorney called it.

lawyers and judges all know each other and work with eachother. the s~~~ you see on tv is garbage. no theatrics, no raised voices. calm disassembly of your lifes work.

1/f of your gross is child support. you make $50 k a year? nope, you have to live on $30k a year gross. Monday is c~~~day. she gets it, tax free. any time you get a raise, she gets a raise. she doesnt work, you pay alimony too.

court is slanted against you. every day in court is money p~~~ed away and the real possibility of jail for you.

not all evidence is truth, but it is evidence. evidence trumps truth any day of the week in the legal world.

It’s not a trial. It’s a hearing. A trial if you can’t afford an attorney one will be appointed for for. No jury for you either. Cruel and unusual you bet your ass.

Whisper in his ear is excellent advice. An example from her deposition. She was asking for $1,500 per month in spousal support. Her 95 year old mother who is in poor health has an investment account with about 1.2 million in it. My attorney asked her the value of the account. She replied she didn’t know. I whispered in his ear “She gets a statement every month. He then asked her if she received statements. She replied yes. He then asked if she reviewed them. Again she said yes. He then asked what was the value of the account. She replied “over a million dollars”. He then asked if she would inherit any of it. She said “One half”. I pay no spousal support. That one whisper saved me about $75,000.

I ain't got a wife to spend my money, I have to do that all by myself.

Assuming you don’t have a major discrepency in incomes, which could be a false assumption if she is not working. But you mention that she has a degree so she will have imputed income for sure. If it was a short marriage you will pay for half the time you were married. That is not much total money. The amount, amortized over 18 years will be minimal.

Your alimony will not be that high.

It is unlikely you will get custody or even 50/50 physical custody (what child support is based on).

Across a wide range of jurisdictions the estimates are that mothers receive primary custody 68-88% of the time, fathers receive primary custody 8-14%, and equal residential custody is awarded in only 2-6% of the cases.

As far as child support, that’s where they get you. Do the math.

Per month this nets out to $212.50 a year, or $2,550 a year. But on average, the latest statistic we have available comes from the 2010 Census. According to the Census Bureau Reports, the average monthly child support payment is $430.Apr 6, 2016

Figuring your income is average you will pay 430 a month for 12 months a year times 18 years is 92,880.00 total child support per child. If you stay you may get half custody if your very lucky and save 50,000.00.

As someone stated above, and it happened to me, you can easily spend 300,000.00 dollars on a custody fight. And, despite me getting 50/50 physical I still had to pay 650 a month in child support.

My advice is to walk away from the child. It’s best for the child rather than getting caught up in a contentious custody fight that will last their whole lives long, at least until you or your ex dies.

If you try to stay in their life your ex will alienate them from you. Let them know you love them but stay away.

Pay the child support and move on with your life. Go your own way. F~~~ her, the kid and society in general.

Children belong to women. Get over it.

Do this and you’ll be fine.

In a custody fight, her attorney will seek to show that you are clueless about the needs of your child. You may be asked the child’s teacher’s name, best and worst academic subjects on last report card, pediatrician’s name, aptitude test scores, last medical check up, immunization schedule, brand of baby formula and feeding schedule (depending on child’s age) shoe size etc. etc.

Know these things and expect to be asked about them. If you have a pool at your house, and your kid doesn’t swim yet, expect that to be used as evidence that your place is a dangerous place for your kid to live. You should also have answers about child care arrangements if you get custody. Who will care the child while you work, etc.

Basically, anything that can be used will be used, regardless of wether it’s relevant, or true.

Look, it's not my fault that tornado dropped a house on your sister. Now get back on your broom and get your ass out of here... and take your monkeys with you

I disagree with you here as you are better off leaving the child on this soil and not get in a international kidnapping pursuit (It is one thing to leave the country without paying the bitch it is another thing to take the kid and have to live on the lam from a kidnapping charge.

Outside of this i do not care if you leave the country or state just don’t take your kid with you as it it will be a harder longer sentence with the FBI tracking you down for it. You could probably get out of the country and flee without a kid but you will most certainly get caught if you take the kid.

Just an east coast asshole who likes to curse, If you get offended by words like fuck, cunt, shit, piss, bitch or any racial slurs then you just scroll down.
