I am a Canadian but I mainly follow American politics. America, The Republic, is the world’s last hope for individual freedom. If anyone out there can elaborate on this story it will be much appreciated.

Sorry guys it pains me to do this but no–its not a violation, it is s~~~ty politics but not a war crime and here is why:
The statute states: “Whoever, when the United States is at war, willfully causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty, in the military or naval forces of the United States, or willfully obstructs the recruiting or enlistment service of the United States, to the injury of the service or the United States, or attempts to do so—Shall be fined under this title or imprisoned not more than twenty years, or both.”
According to the Article “Obama told military members that they have a “universal right to protest against authority,” and that they “can criticize our president without retribution.”
Problem #1: The legislative history of 2388 (Yes I looked it up) suggests that the “war” must be a declared war, i.e. declared by congress, or a “police action”. I neither case some congressional action is required.
Problem #2 Does “protest” or “criticism” constitute insubordination? It can be but is not necessarily. Is it disloyal, or incitement to disaffection? Again it can be but is not necessarily.
I don’t believe as a legal matter this dog will hunt. And even if it did who exactly is going to prosecute Obama? Lorrette Lynch, his own Attorney General? Not likely. Sorry guys.

I guess he’s p~~~ed off that he had to eat his words when he said “I don’t think Donald Trump will be President”.
