Should she have a criminal trial, no. Unless the DA has some incriminating evidence, this is just a huge mistake enabled by lax policy and procedures allowed by the institution, Vandy. I don’t want to minimize the outcome by saying ‘mistake’. It was a colossal ‘f~~~ up.’
There doesn’t have to be intent though? Why wouldn’t involuntary manslaughter apply? I’m not suggesting that medical professionals should be punished for every mistake, but if the nurse knowingly broke policy putting the patient at risk, there should be some punishment for that. At the same time, there should be a lessening of the punishment if the nurse openly admits to her mistake.
The DA could argue for involuntary manslaughter if they can show criminal negligence. However, negligence is more often used in civil rather than criminal cases. Yes, the colloquial definition applies, but does the legal definition? Did she know giving vecuronium would paralyze the patient? Hopefully, yes. Did she know tha typing “VE” into the Pyxis and clicking the first result would dispense vec rather than versed? Possibly not. Did the hospital have in place mechanisms to allow staff to bypass safety checks to dispense medications? Yes. These bypasses are typically meant for use during emergencies like codes or traumas. I think the Hospital will take the brunt of this and she’ll take a plea deal. Hell, the hospital will probably write her a large check to take the plea deal, just to get their name out of the press. This is Vanderbilt Hospital, not some no name place.

Here in the UK, it has been proposed several times that medical negligence claims against state run institutions and staff be capped at £20,000, regardless of seriousness.
It has been dubbed – correctly – as a licence to kill.
