Dude had cancer. Has some sperm frozen in case he lived but the treatment made him sterile. He died. Instead of accepting her fate and dealing with the fact that she outlived her son, she spends her time trying to get the dead son’s sperm transferred to a fertility clinic because she wants grandchildren. Never mind that the kids will grow up without a mother or a father, because who cares about anybody but her.
Luckily the court cared and didn’t give her the dead son’s sperm. I’m guessing that she’s just a peach to be around.

There have been several cases along these lines in the UK. Fortunately, the holes lost.
I have not got a huge problem with the idea of her having the sperm, if she can pass a financial test to show that she can leave enough money for the child to be raised (perhaps also place the money in a trust fund) and then show she has guardians arranged should she die soon.
In the end this is about a mother missing her son and wanting his and her genes to go on. It is very different from a woman wanting her divorced husband’s sperm to secure his finances for the next 18 years. If she has the money and the support network of relatives fine. If she is just expecting someone else to pay like most females, then no chance. That would be my decision if I were the judge.
