Man forced to pay child support even though DNA test proves child is not his

A Florida man has been forced to pay child support even though a DNA test proved that he is not the child’s biological father, First Coast News reports.

Last year, Joseph Sinawa, of St. Augustine, went to St. Johns County courthouse in an attempt to get visiting rights for the child. At the time of the child’s birth, Sinawa had signed the birth certificate believing he was the child’s father. When a judge ordered a DNA test to prove his paternity, he learned that the child was not his.

“I was emotionally devastated,” he recalled.

Although the child’s mother has reportedly told the court that she is fine with Sinawa not paying child support, the state has insisted that Sinawa continue paying.

“At the time it had been taking $83 out of my paycheck, more than one-third of my pay,” he said. “When I thought I was the father, I didn’t have a problem with it.”

Though a judge initially decided that Sinawa should not pay, the Florida Department of Revenue appealed the decision, claiming that he did not go through the appropriate channels to disestablish paternity, according to Brandon Beardsley, who practices family law but does not represent Sinawa.

“It was a waste of Florida taxpayer resources to appeal a decision when the end result is going to be the same,” Beardsley said.

The attorney expects Sinawa, who is representing himself, to be let off at the hook at some point — but not without taking a significant hit to his bank account.

“You’re just making a father pay child support every month now for an extended period of time, which he should not be paying, until he follows these procedures,” Beardsley told First Coast News. “The problem with the department of revenue is that the state is their client, not the mom.”

Well, not really, depends where you look.

Watch the documentary “Divorce Corp.” The judges and lawyers that were part of this, are quite out in the open about how the family court racket rakes in over 60 billion dollars a year.

As well as discussing the inherent conflict of interests that exist all throughout this ‘justice’ system.

Making someone pay for another man’s womb turd is disgusting.
Other Canadian men on the site here already have to contribute their taxes to my kids through social programs, schools, child benefits etc 🙂 That’s bad enough.
Although the Canadian system isn’t as crazy as some State’s are in America I recently met two people who recently got f~~~ed in divorce court. Despite having no Kids they were required to give up a percentage of their pensions to their wives even though they are 15 years from retirement – and HAVE NO KIDS!
These women are barely 50 years old and have already earned a good chunk of future earnings just for f~~~ing a dude for several years. They didn’t even have to provide a womb turd.
Family court, divorce court, it is all a scam to provide for the wimmen’s.
Disgusting.

No kidding.

But I am not talking about the money. I am talking about the laws. The laws are not written to be able to give justice to the man. The laws are written to protect the best interests of the child, over the mans right to justice. this is why family court will not ever allow a man to be reimbursed for child support the court acknowledges he didnt have to pay. Now, he can always take the woman to civil court and sue her for fraud and conspiracy. Can also civilly sue the biological sperm donor too but it takes time and money.
