Few willing to comment on arrest of top education official

Story:

The top Department of Public Instruction official was arrested Sunday following a report of domestic violence that occurred at the <city> residence of <man>. <woman> was later released on bond.

Officials were hesitant to comment Monday on the weekend arrest of <woman>, the state’s superintendent of public instruction, saying more information was needed.

<city> Police received a call from a residence on the 1100 block of <address> at about 1:45 a.m. Sunday when <man>, <age>, reported that <woman> had struck him.

“The victim had a visible injury on his face,” said <city> Police <officer>, who declined to say whether alcohol was a factor in the incident.

<city> Police <officer> said officers arrested <woman> at her <city> home.

“(Officers) met her at the residence, explained the situation and she was taken into custody,” <officer> said.

<officer> said <woman> was transferred from <city> police custody shortly after 2 p.m. and booked at the <city> Detention Center shortly after 4:30 p.m.

A bond hearing was held Sunday night before <city> Municipal Judge <judge>. A $150 cash bond was posted by <woman>’s sister, and <woman> was released.

No charges yet

<woman> hasn’t officially been charged but had been held on one misdemeanor count of simple assault.

<state> Republican Party chairman <name> issued a statement on Monday afternoon.

“This is a troubling reminder of what is, unfortunately, a situation for many families across our state. We hope that this incident will spur a public conversation about domestic violence and will help others in similar circumstances to take appropriate corrective steps,” <name> said.

Gov. <name>’s office declined comment.

“Knowing little about what has occurred, it would be irresponsible to comment at this time,”

spokesman <name> said.

Democratic-NPL Party officials also refrained from weighing in.

“We don’t know all the facts. We don’t have a comment until more details come out,” Dem-NPL executive director <name> said.

The superintendent’s office is traditionally a nonpartisan office, although the Republican and Dem-NPL parties provide a letter of support to a candidate at their party conventions. <woman> is a Republican.

<woman> is scheduled to appear in municipal court Tuesday.

An attorney for <state> Superintendent of Public Instruction <woman> entered a not guilty plea on her behalf Tuesday to a simple assault charge that alleges she struck her fiance with an object Sunday, injuring his face.

Attorney <attorney> said after the arraignment in <city> Municipal Court that now isn’t the time to get into specifics about the case.

“When that time comes, the facts will plainly show that <woman> did not do this and she is innocent of this charge,” he said.

<woman> did not appear with <attorney> in court, which is common for a Class B misdemeanor charge. She faces up to 30 days in jail and a $1,500 fine if convicted.

Municipal Judge <judge> allowed <woman> to remain free on $150 cash bond and ordered her to have no contact with her fiancé and alleged victim, <man>.

A court trial was set for March 23, but <attorney> said there’s a “very good likelihood” that <woman> will request a jury trial and the case will be transferred to district court.

City Prosecutor <name> declined to comment on the specifics of the charge. The complaint alleges <woman>“struck her boyfriend, <man>, with an object causing injury to his face” at his home in the 1100 block of <address> in <city>.

Police were called to the home at 1:43 a.m. Sunday and arrested <woman>later that day at her home in <city>. She was briefly jailed at the <city> Detention Center and was bailed out by her sister.

<woman>, <age>, said in a statement released by her spokesman Sunday that said an argument with  <man> “escalated to the point where I was concerned for my safety,” and that it wasn’t the first situation where she felt at risk.

In a statement Monday from his attorney, <man> said it’s “disappointing that there has been an attempt to discredit me personally as well as what happened. There are other witnesses to verify what took place, but out of respect for the legal process and <woman>, I decline further comment at this time.”

<man> also denied assaulting <woman> in an incident that led to him being arrested for battery last summer by the Orange County Sheriff’s Office in Orlando, Fla. The charge was later dropped.

A copy of the police report obtained by <city> News Service says that <woman>, <man> and <woman> s twin 20-year-old sons were staying in the same room at the Grand Floridian hotel near Walt Disney World.

One of the sons told police he awoke to see <man> straddling his mother with his hands around her neck. The son said he jumped out of bed and fought with <man> and police observed that the son had a large scratch over his chest, which he said happened during the fight.

<woman> had a large bump on her forehead, just above her left eye, which she said she got when she fell and hit her head at the park, the report states.

<woman> told police that “<man>was physical” and that he had straddled her and held her down by her shoulders saying, “this is it,” the report states.

<man> wouldn’t talk with police and wasn’t being cooperative, and he smelled of alcohol and swayed from side to side when he stood up, the report states. Police observed he had a small cut to his lower lip and a cut over his left eyebrow.

While being transported after his arrest, <man> said he was set up by <woman> and her children, the report states. He said as he returned to the room, he kissed <woman> and her son attacked him without warning.

<woman> refused to complete a statement and said she didn’t want to involve police, the report states. The prosecutor dropped the battery charge about a month later.

In his statement Monday, <man> called the Florida incident “regrettable” but said there was no assault on <woman>.

<woman> was in Orlando to attend a summer institute put on by the Council of Chief State School Officers, which ran July 9-12, according to <name>, spokesman for the state Department of Public Instruction.

The $1,680.59 in state money spent on the trip covered her lodging, airfare, miscellaneous expenses such as parking fees and taxis, and some meals, <name> wrote in an email.

“There was no taxpayer money spent to have her sons or <man> accompany her,” he wrote.

Using a weapon makes the assault charge much worse, although they don’t seem to be making a big deal of it in cases like this when the female is the perp.

Women are famous for using weapons when fighting with men. This is why despite men being a little stronger, serious injury to to DV is equal across the sexes.

I’m posting his pic because it’s all over the internet and notice in this pic it says “busted” like he’s the perp.

The true face of domestic violence

Someone posted a pic of a woman who got a black eye and her abuser was, rightfully put in prison.

Now this woman is a top educator. Shouldn’t she lose her job? The people commenting in the paper sure think so.

I think keeping these two apart is the right thing to do, they seem to have a toxic relationship (he’s engaged to a single mom over 40 with kids, any questions?).

Do I think she is a danger to others? No I don’t. This is between them. I don’t see her as a danger to society.

But things won’t change until women are held accountable for their domestic violence. Right now it’s open season on men. Men can’t defend themselves. You hear her, she’s already accusing her accuser of domestic violence and she was “afraid”.

For younger guys remember that word “afraid”. P~~~ off any woman anytime, especially where it matters, at work or at home and she will say “I was afraid”. Try and prove she wasn’t. It’s the new buzz word for “men are evil” combined with “my feelings are more important than reality.

Go your own way, do any of us really need this bat s~~~ crazy ameriskank drama? Especially with the cops with their trigger finger waiting to arrest the man.

(Wow, this is turning into a soap opera….)

Board delays action on state superintendent, fiancé until assault charge resolved

Members of the Education Standards and Practices Board indicated Thursday they would postpone any disciplinary action against the state superintendent of public instruction and a <city> teacher until the court reaches a decision in the alleged domestic violence incident involving the two educators.

The board, which oversees licensing of <state>’s teachers, voted to table the matter.

State Superintendent <woman> was charged with simple assault in February after allegedly assaulting her fiance, <man>, who teaches at three public schools in <city>.

<woman>’s trial is scheduled for March 23 in <city> Municipal Court.

<woman attorney>, assistant attorney general for <state>, said it’s board policy to address situations in which teachers face assault charges.

“You can discipline a licensee if they have been convicted of an offense deemed by the board to have a direct bearing on their ability to serve as a teacher or administrator and not been sufficiently rehabilitated,” <woman attorney> told the board.

<woman> attended the meeting but did not speak to the board.

<woman attorney> also addressed <man>’s police records.

<man>, who did not appear at the meeting, pleaded guilty to driving under the influence in December. In an earlier incident, he was arrested for DUI in 2011, and he pleaded guilty to a reduced charge of reckless driving.

A battery charge against <man> was dropped in July after an alleged domestic violence instance against <woman> in <another state>.

<woman attorney> said the board could choose to take disciplinary action against <man> if he violated a rule adopted by the board. She referenced the board’s code of ethics, which requires teachers to protect students from conditions detrimental to learning or to their physiological or psychological well-being.

“That’s all the information we have,” she said. “As is our policy, normally we wait to get more information before making a decision on these things.”

<woman attorney> said the board will monitor legal proceedings against <woman> and any action taken against <man> by the <city> School Board.

The school board has not taken any steps to discipline <man> though school administrators have placed him on an improvement plan following absences at work.

They are getting ready to fire him and her. He get’s hit they both get punished same old pussy pass.

It seems in NY it’s against the law to hold absences due to DV against an employee. So the school board is breaking the law by holding the absences due to him having in the s~~~ beat out of him by his boss who works for them against him.

Being a victim of domestic violence can affect many parts of your life, including your job. Under NY’s employment discrimination law, you cannot be discriminated against by an employer due to your status as a domestic violence victim. You may file a complaint against an employer if you feel that s/he has fired you, refused to hire you, or treated you differently than other employees based on your status as a victim of domestic violence. Also, if you have to quit your job due to domestic violence, you may still be entitled to unemployment benefits. The laws that protect you are explained below.

Of course this is from a womans law web site.

(I’m not surprised at all with this news…)

A simple assault charge accusing state Superintendent of Public Instruction <woman> of striking her then-fiance with an object has been dismissed for lack of evidence, City Prosecutor <prosecutor> said Friday.

Authorities arrested <woman> on Feb. 15 at her <city> home on suspicion of simple assault, a misdemeanor punishable by up to 30 days in jail and a $1,500 fine.

<city> police said her then-fiance, <man>, a teacher at <school> in <city>, reported that <woman> had assaulted him at his home early that morning. Police said <man> had a visible injury and dried blood on his face.

<prosecutor> said there were two witnesses to the incident, and, while they saw <woman> throw some things, “neither of those two saw anything strike the victim.”

“So, I don’t think there’s enough to prove that the injury occurred as a result of her throwing something,” <prosecutor> said.
