So, light of that, if prostitution were legal, then couldn’t man buy a woman a drink to have sex, be considered a business transaction if she agrees to accept the drink in exchange for sex?

In short, I am curious how yes means yes laws hold up if having sex were legally seen as a business transaction.  Actually, couldn’t a guy then take a woman to court, after paying for sex, if he failed to get any sex from her?

So, in short, you are saying what is going to happen would be the opposite of what I was thinking here?  I was thinking that prostitution being legal would enable sex to be treated as a financial transaction, which would require delivery of services for money rendered, so if a guy paid for X, Y, Z to be done with him, and she failed to, it could be a problem, or at least it can be shown that she paid for this, and was agreeable.  But, you are saying yes means yes laws will mean that even prostitution is going to be broken by the law, and a prostitute, after getting money, could claim the man raped her?   Well, if that is true, it looks like men won’t even have a chance at prostitution as a way out.  There will be no outlet for men to have sex, if this is a case.

On the other side, couldn’t a man end up charging a woman with rape, if she did things and he later on regretted it?
